Consider Home Rule? - What Home Rule?


The Clayton Town Board has submitted a letter to the NYPSC.  Below is a quote from that letter.

 
"The Town of Clayton, as a stakeholder in the Cape Vincent Wind Power project, recognizes that the adoption of PSL Article X has allowed applicants to utilize New York State's process rather than local zoning for siting all major energy generation facilities. While we understand the State's rationale behind the promotion of new sources of energy, we ask that strong consideration be given to Home Rule, as it has been a viable municipal management tool for decades."
 
What is it that the Clayton Town Board doesn't get about this????  ...strong consideration be given to Home Rule?  Let's see Clayton, would you be referring to the Home Rule that the State already took away on this issue??
 
So what does Clayton think is going to happen?  Do they think the NYPSC is suddenly going to give Home Rule back? Consideration?????  Do they think we can retain Home Rule if the State considers it and only preempts CV's law a little bit???
 
The fatal error in thinking by Clayton and CV that is nothing more than rational to somehow  make us all feel better about having our rights removed is that if Art. X upholds Cape Vincent's zoning law that somehow this means we have retained Home Rule.
 
Doesn't matter what decision the Art X board makes on Cape Vincent's zoning law, whether they preempt it or not.  It will have NOTHING to do with Home Rule.  That is because the State will make the final decision on the CV's zoning law no matter what.  If the State makes the decision...that is NOT Home Rule!
 
Did it ever occur to Clayton that if they have to ask the NYPSC to consider home rule in the case of CV's law that then Home Rule doesn't exist on this issue any more?
 
The bottom line here is that this part of the Clayton letter is just plain goofy, and that is another example how Art. X has everyone running around in illogical circles thinking they still retain control that doesn't  exist because the State took it away!!!
 
Well I guess when the turbines go up in CV people will finally get the picture!
 
The hard truth is that nobody seems to want to deal with is that  if you want Home Rule on this issue then you better start seriously considering an alternate strategy to take it back and defend it instead of writing the State nice letters begging them to "consider" Home Rule!!
