The town Website lists special use permits as the responsibility of the Cape Vincent Planning Board. However, as I read the new Cape Vincent zoning law, it appears that may be in error and special use permits are the responsibility of the Zoning Board of Appeals, not the Planning Board. NY Town Law allows the Town Board to delegate that power to either board as it sees fit.
Is that important? Well, it might be if you are....let's say reviewing a ground based solar project that in Table 8 of our new zoning would require a special use permit (SU)
You know...so our "zoning experts" would make sure the review of that project permit got before the correct board. Hey... I'm just sayin!
Of course with all these "zoning experts" it wouldn't be possible for a project to even get before any CV board for review, and public notices and letters are sent out of a public hearing when then somebody suddenly claims after the fact it doesn't actually need a review? Right?
