WOW- We Are Really Kicking BP's Ass So Far In The Art. X Process.
In the tracking report of BP's Public Information Plan activities submitted to the NYPSC there was an interesting item listed. It involved Dept. of Defense (DoD) military radar interference.
According to BP's PIP an FAA specialist has reviewed the BP CVWF project and decided there is no problem to military radar and that is settled and there will be no more done on the issue. Even though the BP project sits right on the US border and not far from a critical and very active army base at Ft. Drum.
But wait...once again, like the Blanding Turtles, the Indiana bats, the birds etc, this was supposed to be a big deal that could kill or delay BP's wind farm.
Apparently the DOD sees NO PROBLEM!
So the birds don't seem to present an issue.
The radar isn't an issue.
The turtles don't seem to present an issue.
The bats don't seem to be an issue.
The scenic view isn't an issue because our zoning lawyer says you can't prevent BP's wind farm on scenic view grounds.
The NYPSC commissioner married to the BP CVWF lawyer isn't an issue.
Our zoning was created in fear of Art. X and to appease the State, and it actually allows some wind development.
Clayton won't support our zoning law because the turbines are too close to their town border and the river.
BP keeps stringing the town along and won't answer any of the town's questions since BP controls the process.
Town officials are accosted by BP supporters at a BP open house.
BP has to respond to public comments on its PSS but the NYPSC can't force them to take or follow the town's recommendations.
Our home rule rights have been stripped away, and our zoning can be preempted.
The State will decide the fate of our zoning law, and that will be after BP gets a crack at it!
WOW...so far we are really kicking BP's ass in this Art. X process.
